Judge throws out 'filthy taxi' charge


A MAN charged with driving a dangerously defective and "filthy" taxi has had the case against him dismissed after a judge ruled there was no evidence linking him to the cab.

Lee Gallagher (45) had been accused of driving a cab in Dublin city centre that was found to have worn tyres and a faulty clutch and gears.

The 17-year-old taxi, which had clocked up more than 400,000 kilometres, was impounded at Grafton Street.

Mr Gallagher, of Ivory Cottage, Convent Road, Bray, had denied charges of dangerous driving, having a dangerously defective vehicle and an unfit public service vehicle.

The car was seized at a rank at the Grafton Street rank on May 4.

Judge William Hamill dismissed the charges at Dublin District Court. He said there was "nothing to connect anybody to the offence except the registration plates".

Strange decision by the judge? We only got a brief summary of the case . The reason I point this out is there no Convent Road in Bray.

I wonder if there's any law which requires the owner of the vehicle to say who was driving the vehicle (as there is in the case of speed cameras) at the time of the offence, and would the council have the power to request the information or just the police ?

If he wasn't caught in the vehicle or driving it at the time it was siezed then he could say he wasn't driving, then again it was at a rank so presumably he was with/in charge of the vehicle.
