while hes away nip round HIS side and chuck "meadow" seed all over his gardens, and write "W****R" in weedkiller on his lawn, if you have a cat and/or dog save up thier assorted waste and chuck it over his fence, torch his fence and plant landmines in his drive.....no, forget that

he's reappeared seems he just dissapeared for 25hours because he knew I would be angry about him tresspassing on my garden without my permission

The trouble is as soon as you do something against him you are immediately the one in the wrong I thought that I might issue him with notice of intention to prosecute for illegal trespass and state on it that due to the history of tresspass (this isn't the first incident !) I will only speak to him through HIS solicitor which will cost him money but I am not sure if I can legally do that

Are you sure that the law regarding trespass exists in this case? I would have thought that criminal damage may be a better option. Of course if you are going down the legal route you will also end up with a legal bill because his solicitor will then only communicate through your solicitor.

I expect a major legal bill BUT if I can cost him some money as well he will think twice next time this is the latest in a string of incidents over the last couple of years some of which have cost me money already !

Neighbourly disputes must be quite common, Years ago I put a 4 foot high fence up along the boundary with my neighbours garden...all of the fence was at least 6 inches within my side of the defined boundary, I even put a gate up so the kids next door and our kids could play together easier.

All went fine for about a month until Mr Buggerlugs next door decided to block off the gate with bits of Pailing bars and nails...that lasted for about 4 months and was upsetting the kids. Anyways...one dark Night and an Axe remedied the problem and they gate stayed usable for years after, and Mr buggerlugs even started Speaking to us again...

Funny old world aint it!!
