The 1847 act defines what a taxi is, and what it can and cannot do.

And a non local taxi isn't allowed to do what the act says a local taxi can.

I might be getting myself confused but had it in mind a hackney must return to a rank when not on hire. I understand "plying for hire" includes driving around a bit and so a hackney can be hailed in the street.

My interpretation of the wording of various acts is that a hack can only accept jobs whilst parked on a rank or when flagged down, so no, they can't (shouldn't !) make themselves available for hire unless on a rank or whilst in motion.

Illegal touting is the way courts view that.

In most cases i'm sure it would be the punter who would hail the driver therefore the driver would be within his right to explain the situation but offer his phone number/booking office so as to legally pick up the hailing punter.

He would though be guilty of plying for hire outwith his legal conditions and breaching his terms of insurance.

Just to enlarge on my original question, I was siting an example being within the LA that licenses the hack. It does seem odd that whilst in motion within the LA with for hire lights on is "plying" but whilst stationary with lights on but not on a rank is "touting". I do understand that "lights on" out of your own LA is a no no.

So whats wrong when i park outside the chippy eating my chips and i get a walk up/ job..Nothing

A hackney can only legally ply for hire on a rank. They cannot sit anywhere they please with their light on, that is illegal and of course they can legally be hailed whilst on the move. Just be glad you're not private hire, we're supposed to sit out of sight of the public, htf we do that is beyond me :lol:

Surely if you're eating your light isn't on, but, I would think it's still illegal for you to sit there with your light on, you should move out of the sight of public eyes then you wouldn't get a 'walk up'. It seems to me hackney drivers think it's ok to tout :roll:

You are breaking the conditions of your local authorities licence by plying for hire out with your licensed area, there has been plenty of cases where by operators doing just the above have been charged in Liverpool.


An English Hackney Carriage and it's driver are governed by statute law and bye-laws.

I agree with Brummie, Mr T wouldn't be asking without a reason.

There is a reason for the question..... we all know that it is illegal for private hire vehicle to pick up off the road..1976 Act.... which nowadays means that drivers are being prosecuted and have points fixed to their licence... but the same Act does not apply to Hackney's imo ... now years ago if a Sefton hackney was prosecuted in Liverpool it would be for breaking a bylaw... which would be a fine..... now they seem to think a hackney driver should also have points on his licence.... I am wandering which act or law covers this...


Whilst the bylaw hasn't changed is it possible for them to change the punishment? I'm inclined to agree with gusmac on this in so far as the points may be added because of the insurance (or lack of) but then again nowadays if you don't have insurance (which this implies) they take the vehicle and crush it :?
