Every policy will do that UNTIL and UNLESS the claim is settled with the third party's insurance company.
Have you bothered to follow the claim's progress via Westminster?
If they HAVE recovered their outlay, then your NCB will have been re-instated with them back to the date of the accident, which in turn is then transferable to your new insurer and you are entitled to refunds of any premiums overpaid because of incorrect NCB being used at the time the premium or premiums were paid, due to the unresolved claim.
Claims can take a year or two or more to settle, but if they are settled in your favour you are entitled to your NCB being reinstated back to the day of the accident.
However, if Westminster never recovered their outlay because the third party were not insured or the claim was disputed or whatever, then the above scenario does not apply and you will lose your NCB.
