If they wind you up they cant have what isnt there..... so they will have cut their own throats


what was the order form/contract in the name of? the ltd company or an individual?

It is in the company name but we are not going down the route that you are thinking. I have an update to post shortly.

****UPDATE****

Dear Mr XXXXX,

Firstly I would like to apologise for the delay in replying to you, I have spoken with the Kinesis department in regard to this matter and they have agreed to raise a credit for the remaining contract on the account, the credit amount is £1536.00 this has been raised due to the problems which have occurred

A credit was previously raised for GuardCard charged on your account and unfortunately no further credits are due

This has therefore reduced the outstanding balance to £1036.27, if this balance is paid the account will be closed and no further action will be taken

Well we are nearly there. Some of the remainder is for fuel and a lost device which I have no problem with paying. The remainder is £550 plus VAT for having 10 units removed from our vehicles. I am still going to dispute this payment because I don't think We should have to pay for their crap units to be remover which was to cut a cable tie and unplug from the OBD port.

nip to companies house, start a new ltd company, dissolve the old one, leave them sucking thumbs/scratching arses

I don't think we need to go down that route. I have just sent them an email stating what we have already paid for a couple of things and what we owe for outstanding fuel and a lost tracker so taking one from the other I have offered them £11.93. I have not offered anything for the removal of the trackers from our cars.

If the goods were not fit for purpose then other than the small amount you admit is due, I'm struggling to see why you should pay a penny.

On a different note, why can't you track your motors via the dispatch system?

The dispatch system only shows the vehicles whilst they are on duty. Most of the drivers take the cars home and once logged off we do not know if the drivers are using the cars. Also the dispatch system is prone to loosing signal due to it using the drivers mobile phone.

As I am sure you are aware to try and get a winding up petition is for where a company can't pay it's debts. As we have made it clear that we are disputing these charges I am sure that any attempt to secure a winding up petition would be seen as an abuse of legal process. We have made it clear what we believe we are required to pay and if we are unable to agree on this I think it should be for the courts to decide and of course should the court decide in your favour we will abide by that decision. Therefore we must insist that you take this course of action. Any other form of trying to recover a disputed debt will be seen by us as intimidation and will be reported as such.

They are not happy. We are back to them threatening us with debt collectors calling to the directors houses even though this is not allowed as it is a limited company debt. They have said that they are going to press ahead with a winding up petition because they don't think we have the money to pay. I sent them a copy of our company savings account with a deposit for 2 times the disputed sum on deposit in case we lose any court case. They must think we are stupid to think they can go straight for a winding up petition without first obtaining a County Court Judgement.
I am enjoying this.
