till july.....
When TUPE will apply again...

only if county keep the details the same, they could decide to alter it

Grandad has a run with 3 kids now (i think) but LCC could add or subtract kids, alter the need for an escort or whatever they see fit making it a totally different job, or the kids could leave or move to different schools or units, with a coach run of 50 kids its fairly constant but with pupil taxi jobs from 1 to 8 kids in HC/PH vehicles its anything but

However my son received a phone call at 11.15 this morning from county hall asking if we were in a position to accept the contract because the new operator had sent it back.

Happy New Year.

But you can't represent members who weren't members when the incident happened.

Don't forget also, that any driver doing a council contract must also be paid the min wage, along with the escort, that's what our council stipulate, but how can an alleged driver be both self and employed????

That is simple. I am employed by our company to do school runs and run the office. I also run my own business as a sole trader for which I am self employed.

A good result there for you and your staff. I'm glad my own experience has helped someone else.

when I incorporated I was told my S/E ended and all assets became the property of the Ltd company via the "directors loan" account

I am not a director of the company. I am the office manager and an employee. The directors are my wife (the majority shareholder), my son and his wife.

I have just returned from a taxi forum meeting at County hall. The agenda covered TUPE. The speaker gave a broad outline of the situation and how County Hall will be changing their contracts to allow for TUPE. The operator who my staff had the problem with is also on this forum. He is still maintaining that he is correct and that everyone else is wrong. #-o You could see the eyes rolling at the top of the table  . One of the other operators stated that they also don't have any employees only self employed and they even stated that drivers were paid £4.00 per hour. I hope that bit gets put in the minutes.
He is also convinced that you cant have a self employed driver and an employed escort on the same job. =D> =D> =D>
