as i said, theres no company name register now, so its only a registered trademark that could claim copyright, so it just depends

Ltd company, trademarks etc, all largely irrelevant I suspect.

I mean, a firm of accountants like Ernst & Young might be a partnership, yet to that extent you think they can't protect their business name?

It's probably a bit more like copyright rather than having to register a trademark - if you write an original piece of work - an article in a magazine, say - then you don't have to have the little © symbol and all that to claim copyright - it's automatic.

Indeed, the leaflet on 'passing off' that I linked to said:

Thus 'passing off' and trademarks are clearly related, but not precisely the same.

By the way, wanna, trademarks and copyright are different things as well.

Your business name could be a trademark, but what you write on here you have copyright over.

I know copyrighting the toplight would probably cost more than its worth

maybe the Ltd company/rooflight design owner should issue a statement in the paper

"We XXXX cars of fareham wish it to be known we have nothing to do with any other taxi firm in the area blah blah blah"


or just ignore a 1 man owner/driver, he cant win after all

To avoid any legal action I changed the colour of the sign and to spoke to m/d concerned for his approval!
