There is no loophole, its fiction. Drivers dont HAVE to do anything, if they WERE self-employed they dictate when they work! |

the "I realise i am responsible for my own tax an N.I. contributions" dodge doesnt wash, and i know a guy who HMRC caned for £50K resulting in him selling up and ending up with nothing, so be warned Basic checks to help you decide You can usually work out your employment status by asking a few straightforward questions. You are probably self-employed if you: * run your own business and take responsibility for its success or failure * have several customers at the same time * can decide how, when and where you do your work * are free to hire other people to do the work for you or help you at your own expense * provide the main items of equipment to do your work You are probably employed if you: * have to do the work yourself * work for one person at a time, who is in charge of what you do and takes on the risks of the business * can be told how, when and where you do your work * have to work a set amount of hours * are paid a regular amount according to the hours you work, and get paid for working overtime - even if you do casual or part-time work, you can still be employed |

They are emplyoying in all but name. The owner also is dodging the vat man because he is handling 100k+ per year.

I think this is dangerous myself, surely anyone whose cabbing and earning less that a fiver ph over the course of a week is gonna know it's time to find a new job, the whole way things were set up for payin's was fuel and 50/50 from the remains, or 60/40 in the firms favour but firm pays the fuel, or fixed amount each week which is a gamble if the driver so wants to risk it, the whole problem is too many cabs full stop, until numbers drop earning it will remain hard. |
