Hackney Carriage and Private Hire Licensing Penalty

The Licensing Manager presented a report to enable members to consider whether to withdraw the hackney carriage and private hire licensing penalty points scheme.


Members were advised that a penalty points scheme was currently in operation in respect of hackney carriage and private hire licensing. The purpose of the scheme was to maintain a code of conduct for hackney carriage and private hire licence holders.


It was reported that the current penalty points scheme provided that if a driver, proprietor or operator accumulated 20 points within a period of 12 months, he/she would be requested to attend a meeting of the Licensing Regulatory Committee for consideration of his/her suitability to continue to hold a licence. Whilst Licensing Enforcement officers regularly issue penalty points to individuals for various breaches of hackney carriage and private hire regulations, there had been very few cases where a person has accrued 20 points within a rolling 12 months period. Therefore, matters concerned with the accumulation of penalty points had rarely been brought to this committee for its consideration.


It had been envisaged that the penalty points scheme would act as a means of deterring people from carrying out actions in breach of the various taxi regulations. However, as stated above, officers regularly issued penalty points for various irregularities although in most cases the circumstances giving cause for the issue of a penalty notice were relatively minor. Officers were of the opinion therefore that the penalty points scheme had little effect in helping to ensure compliance with the regulations regarding hackney carriage and private hire licensing. Also, administration of the above scheme was particularly burdensome, and took up a significant amount of Licensing Enforcement officers’ time which could be used more effectively.


The Licensing Manager considered that the hackney carriage and private hire licensing penalty points scheme should be withdrawn with immediate effect. Members were assured that officers remain committed to the enforcement of the above function and will continue to carry out their duties in accordance with the established Licensing Enforcement policy. Members were advised that should they be minded to approve the recommendation contained in the report, such a decision would not preclude the committee from reinstating the penalty points scheme in the future should it be considered necessary to do so.

It was proposed by Councillor **** and seconded by Councillor ********:-


“That the content of the report be noted and that the recommendation to withdraw the penalty points scheme be approved with immediate effect.”


Upon being put to the voted members voted unanimously in favour of the proposition, whereupon the Chairman declared the proposition to be carried.

Resolved:

Which council is that that is joining with East Staff and Breckland to bin that crazy inefficient enforcement practise?

Clearly the LOs have realised it's not the panacea they expected.
