HACKNEY CARRIAGE DRIVERS A and B

The Chairman welcomed all present to the meeting and advised on the remit of the Licensing Panel in determining this matter. The Panel would have to determine whether, given the evidence before them both written and verbal, the drivers remained fit and proper persons to hold Hackney Carriage Driving Licences. Prior to the commencement of the meeting, the Licensing and Litigation Lawyer had also had an opportunity to advise both drivers on matters of procedure and the remit of the Panel.

The Panel gave consideration to the confidential report of the Director of Services that gave details of an incident between the two Licensed Hackney Carriage Drivers at ******* Train station that had been witnessed by a member of the public. The witness was not present at the meeting but both drivers had been given the opportunity to submit questions to the witness, which had been declined by both drivers.

The Panel heard evidence from both drivers and their representatives as well as two character witnesses for Licensed Hackney Carriage Driver B.

The Panel retired to consider the merits of the case.

There were three options available to the Panel; these were to suspend or revoke the drivers licences or to award penalty points. Taking into account all facts contained within the report and the verbal evidence provided by the drivers, the Panel took the decision that the behaviour of both drivers was unacceptable but it did not warrant the revocation of either Licence.

The drivers were awarded 4 and 6 points respectively, in accordance with condition 43 of the points scheme. These points were placed on their Hackney Carriage Driver’s Licences and would remain for a period of 12 months. The purpose of the scheme was to record misdemeanours and to act as a record of the driver's behaviour and conduct so as to ascertain whether they remained a fit and proper person to hold the relevant licence.

RESOLVED: That

1) 4 Penalty Points be awarded to Hackney Carriage Driver A; and

2) 6 Penalty Points be awarded to Hackney Carriage Driver B.


(This matter was considered exempt from publication by virtue of Paragraphs 1, 3 and 7 of Part 1 of Schedule 12A of the Local Government Act 1972, as amended).

Are you saying without the penalty points system no action would have taken place?

Or are you saying a suspension or revocation is the better option?
