Last Wednesday night one of our drivers went up to his girfriends after he'd finshed work, she was at her house with a few of her mates. They started having a dig at him for some reason or other so he got up and left.

During the time he'd been there he'd had a few drinks, he stormed out of the house and drove home in the taxi. His girlfriend phoned the police to tell them he'd driven home, she told them his address and what car he was driving along with the registration.

The Police went round to his house and knocked the door, his father answered the door because he was just about to go to work, the police said to him, "who's been driving this car within the last 30 minutes"? His dad said, "my son". The Police said can you go and fetch him please? He came to the door, they took him to the car and breath tested him. The rest is history.

They took him to the station where he was double the DD limit.

He's in court this morning and as we all know he's looking at 18 months ban minimum, the Council revoked his badge yesterday morning which I can't fault them for doing, in fact the Police should have notified them Thursday morning but did they? Nope.

All I can say is what a tvvat.

Gap between driving and going into the house before the breath test means he could have had the drinks at home. Police can't prove he was over the limit whilst driving the car.

What was the court result, did he plead not guilty ?

A stupid thing for him to have done but sounds like she's a real bitch and he's best off dumping her thing is its not just an 18 month ban because he'll find that the insurance loading will peobably prevent him being able to get insuarance to drive a taxi for 5 to 6 years

He got a 9 month ban, (don't know what 9 month is all about) might have been 12 if he went on the DD awareness course it's down to 9 months. He's done for driving taxis for the next 5-7 years.

Did he not get advice from a solicitor, not just the duty one ?

If I was to pop into an off-licence at the end of my shift to get a some booze and a half hour later, after necking 1/4 bottle of vodka, plod knock on the door and ask who was driving the car earlier I could get breathalised and done for drunk driving ? Even though the police haven't seen me driving and I'd been in the house for some time ?

I'm not condoning DD, I've lost count of the number of cars I've reported to the police in the early hours, but this seems something that could have been got out of pretty easily.

I agree with Sasha, with some legal representation and 'a few drinks after arriving at home', the CPS would have been hard pushed to prove the excess alcohol charge, it would seem he stitched himself up a treat.

Can they not back track the alcohol intake!? I am sure that if he had denied it that is what they might have done to prove their case.

Not in a simple excess alcohol charge.

The EBM only provides a breath sample read out, not a scientific analysis of the subjects eating / drinking history !

Maybe in an autopsy for murder or the likes . . .
