Post subject:  SKDC messing up consultation again !

Got a letter today from Mr excuses telling me to have my meter changed with a new tarriff card enclosed aparently there was a consultation period which ended on the 27th january not one of my drivers was aware of this I haven't asked drivers from other firms yet. I am getting fed up with this patchwork approach by the council where a few drivers get letters and the rest don't unfortunately I don't buy the local rag although I was told that an adverticement appeared about the increase in badge fee's I haven't seen or been told about 1 about fares.

I have now got to organise a drivers meeting a bit sharpish to ask them if they want to go along with the council rate or hopefully persuade them to go with our own

For those interested they have gone with a flagfall of £1.70 with £1.80 a mile which means that there will be even more incentive to the cherrypickers to refuse the small jobs I would have been happier with £1.60 or £1.70 a mile but include some of it in the flag that way the little jobs are worth more but the longer jobs are better value for the punters and even at todays fuel prices £1.70 a mile covers it OK

Mind you I know what my drivers will say they will be petrified of the thought of their meters starting higher than the competition even though the all the main competition are heavily discounting their fares

Surely the New Tariff will be Mandatory across the District, from a given date.

I suggest that you read your local Terms and Conditions, I am told that, in most cases, the Metered Tariff is the maximum a Taxi may charge for the job. Not necessarily what the Customer is Charged.

For example: A Driver may decide to give all Regular Clients a 20% Discount and all new Clients, that book through the System, a 10% Discount on the Tariff Metered Rate.

Nope SKFC is FULLY deregulated we can set our own fares or adopt the council default rate

Is this legal?

Does any other council do this?

If they are setting a rate outside of the act then it could well be illegal

And if they are setting a rate within the act then drivers not adhering to it (or lower) are acting legally.

Bit of a mess really.

I certainly don't know the legal ins and outs of this, but my understanding is that a council either sets a rate or it doesn't, but if they do set a rate then all the HC meters would be set at that rate?

Different firms setting their own metered rate is for PHVs (assuming they have meters fitted)?

that has been the case for nearly 20 years now there have been several discussions on this in the deregulation section of the forum and also the cab act section of the forum

CC can even give you a link to the court case that triggered it all off

Take a look at this:

8.1.5 When a journey ends outside the district boundaries of the Authority a fare greater than that that would have been shown on the meter may be charged but only if an agreement has been made with the hirer in advance.

So we're both, more or less, right.

Finally got hold of Mr Excuses apparently because the fares are deregulated there is no legal obligation to consult the drivers BUT we as drivers have a legal obligation to change our meters within 14 days or notify the council in writing within 7 days if we are going to use a different table of fares
