a truck drifts across the lanes on an island

hits me

but HE claims for damages and my insurers feel a 50/50 payout is best each way

THIS is why premiums are so high

So does that mean you get a 50/50 payout for your damages, losses, injuries, mental health breakdowns and undisclosed other issues?

You should have asked for a witness before. I am sure someone on here may have seen the incident.

I hope you have put a claim in against them then ! It wouldn't surprise me if they aren't insured by the same company it can make a big difference as I found to my cost years ago

The wagon driver will say you got on his blind side. 99.9% of claims against wagon drivers end up losing because they use the blind side rule.

no nige, i said his truck was no bigger than my old 7.5t, his was a small tipper, like the old class 3, maybe a 17t, not an artic, still big enough and had lights and indicators none of which he felt the need to use
