Paignton father's sentence cut for teenagers' attack


A furious father attacked two teenagers after his seven-year-old son came home from a playground in tears complaining he had been pushed over by a group of footballers.

Cabbie Richard Hyde, aged 41, punched a 15-year-old boy in the face and hurled a 16-year-old into a holly bush after going to the park in Paignton to confront them.

His 12-year-old daughter tried to stop the violence, shouting "Daddy, don't" as he approached the youths, Exeter Crown Court was told.

Hyde, of Sands Road, Paignton, denied two common assaults but was convicted at an earlier hearing at Torbay Magistrates where he was jailed for four months last week.

He was freed on appeal by Judge Erik Salomonsen who said the lower court should have stuck to an indication at the time of his conviction that he would receive a community sentence. The judge overturned the four-month jail term and replaced it with a 12 month community order and 60 hours of unpaid community work.

He told Hyde: "You assaulted two young men in a park. At the time you were convicted there was an indication you would receive a medium level community sentence and you had a legitimate expectation that would be followed.

"A community penalty was justified by the gravity of the offence. In passing sentence I take into consideration you have now spent eight days in custody."

Mr Howard Phillips, prosecuting, said the victims were playing football with friends in Foothills Park, Paignton, when Hyde's children disrupted their game and the boy was pushed away and fell over.

He said: "The boy started crying and said he was going to get his dad. He went back home in tears. His father saw him like that and lost his temper and went back to confront the footballers.

"He had clenched fists and he had his two children with him. The girl said 'Daddy, don't' but he went to the first boy and punched him in the face with what witnesses described as a hook.

"The 16-year-old grabbed Hyde to get him off his friend and he was also punched in the face and pushed into a holly bush.

"An independent witness said she had never seen anything like it and was alarmed to see a man behaving like that in front of his children. Hyde walked away shouting he would come back.

"He later told police when his child came home in tears a red mist came down."

Mr Niall Brooks, defending, said Hyde arrived for his sentencing hearing expecting a community sentence and left his taxi outside.

He said he has been locked up 24 hours a day since and would lose his taxi licence if the jail term was confirmed.

Ah, he should've let the older kids bully his kid and then gone round to get kicked to death like Garry Newlove was, it's typical protect the perp behaviour again.

Now before I get the 41 hitting 15 & 16 yr old, are the teens 6ft tall and built do we know, and if a 15 & 16 yr old are going to pick on a 7 yr old, well what's good for the goose eh.
