Does anyone know what the procedure is to make a claim for vehicle repairs in a case where the guilty has confessed and been nicked, what can be claimed for (loss of value? estimated repair costs? loss of use?) our lad is desperate to avoid making an insurance claim (2 years unprotected plus current year to lose) as hes only 19 and NCB is worth more than the car which would be written off if he did claim. it wasnt a crash, it was criminal damage. |

When i had me windscreen put through i followed the pr@ck to hes house the police arrested him but couldnt interview him cos he was so drunk ,so they locked him up to sober up .He admitted it the day after ,the police persuaded me not to take it to court ,repair the windscreen and provide a receipt.I asked about loss off earnings (rest of saturday nights shift,sunday and monday night) because I couldnt get it repaired till tuesday.The police negotiated a deal between us after explaining that loss of earnings would be a struggle(ie providing self employed proof). I agreed to accept £250 the pr@ck came in the office and left £150 never seen sight nor sound of him since ,I phoned the police back on several occasions to chase up the missing £100 they tried but failed to contact him ,in the end I gave up as it was now a civil matter after accepting the offer of £250. If its criminal damage demand to go to court. |

The first rule in taking somebody to court is to make sure they have the money to pay you if you win.... personally I would go and knock on his door.... |

If you want to take it through the courts, then your first step is to go to the County Court, tell them that you want to make a claim against somebody [used to be called Small Claims] and they will give you a set of leaflets / booklets [7 or 8 I think], giving all the different stages of making a claim, from initially writing a letter to the guy, then final demand before court action, all the way through to instructing bailiffs, should your claim be successful and he still doesn't pay. |

You need to find out when he is before the court, if it hasn't happened already. If the case has been dealt with then you wont get compensation, unless the court/CPS has an idea of what compensation was required. If the case hasn't been dealt with, you can find out by ringing the listings office at the court, then send listings a bill for your compensation. The court has to give reasons not to issue compensation, so generally if asked they grant. And compensation takes precedence over any fines that may be issued. |

the copper who put through the highest of three quotes (turned down as inapproprate) has said the guys being charged i dont understand how (it seems) someone can cause £2K+ of damage and (i bet) get some supervision order i also cant understand why our lad (all 6ft of him) didnt have to be dragged off the culprits bruised and bleeding body..... |

Unions are rabble rousing labour puppets, and i speak as a child of the 50's having worked through the 70's dodging red robbo, scargill, mick mcgahee, and all the rest who gave labour millions of pounds and millions of block votes only to be broken hearted when "hardcore" labour men bought british gas shares and thier council houses... scargill still has his NUM flat... |
