If it was a simple case of forgetfulness fair enough but he was not in a position to get it tested nor was the vehicle in use so I think that is a bit rough

What would have happened if he had de-licensed the car, and then re-licensed it anew?
I would appeal to a higher department boss or your local Councillor as this seems utter madness. Might even be worth contacting the Ombudsman, but that must be after a council complaint.
