Hi all.

Wonder if anyone can spray some light on this.
We had a stop check by the minstry and police the other month it has come to my attention that someone got taken off the road because the travel on the handbrake was to much.

It did work we leave in a town surrounded by hills and the chap siad that he has never had a prob applying an getting out of car.

To rub salt into it the police gave him 3 points for defective brakes.

The front and rear foot brake passed no prob.

Cant find anywhere that defective handbrake is a pointable offence anywhere. Especailly 3 points for to much travel. What constitutes to much travel??? If it works and hold the car without any problem on a steep hill who the hell would think they had a problem..

Anyone come across this before or can shed and light on the law.
Seems rather harse and a [edited by admin] take to me.

I suggest he appeals against the decision.

Then they will have to front up all the evidence, and will have to show what's the difference between a pass and a failure, and how anyone can check anything properly on a road late at night. :?

According to the DVLA website you can get points for the following construction and use offences:

Construction & Use Offences

CU10 Using a vehicle with defective brakes.......... 3

CU20 Causing or likely to cause danger by reason of use of unsuitable vehicle or using a vehicle with parts or accessories (excluding brakes, steering or tyres) in a dangerous condition.......... 3

CU30 Using a vehicle with defective tyre(s).......... 3

CU40 Using a vehicle with defective steering.......... 3

CU50 Causing or likely to cause danger by reason of load or passengers.......... 3

Your mate's 3 points seems a bit harsh though, assuming he was telling you the full story.
