RP.13/13 APPLICATION FOR A LICENCE TO DRIVE A HACKNEY CARRIAGE

(Public and Press excluded by virtue of Paragraph 7)

The Licensing Officer submitted report GD.14/13 regarding an application to drive a Hackney Carriage.

The applicant, DD, was in attendance at the meeting.

The Acting Legal Services Manager outlined the procedure the Panel would follow. DD confirmed that he had received, read and understood the Licensing Officer’s report. The Acting Legal Services Manager advised DD that he had a right to be represented but he indicated that he did not wish to be so represented.

The Licensing Officer outlined the Driver’s licensing application, his offences and the number of points on his current endorsed licence. DD had successfully passed the Local Knowledge Test and DVLA Drivers check, DSA driving test and medical test.

DD addressed the Panel and outlined the background to the offences to which he had pleaded guilty and been given a total of 18 penalty points in May 2010.

DD explained that, after considering DD’s plea of exceptional circumstances, the Magistrates had agreed not ban him from driving but had imposed a fine and issued 6 penalty points in respect of each of the 3 offences. He explained to the Panel that he had wanted to be Hackney Driver for some time and had a job waiting for him if he was granted a licence.

The Licensing Officer reminded the Panel of the relevant Legislation and outlined the options open to the Panel.

The respective parties then withdrew from the meeting whilst the Panel gave detailed consideration to the matter.

RESOLVED – That, having given detailed consideration to the matter and taking into account the Applicants statement and his motoring convictions, the Panel agreed to grant the application for a Hackney Carriage Driving Licence.

true - but they can report that the council issued a license to someone who has 18 points - like they can report the council immediately suspended a driver for an offence of alleged rape :shock:

Well they obviously don't consider it as news worthy as reporting suspected offenders of rape and with suspected offenders they have names and addresses to print as well, which they do frequently with no apparent concern to the consequences for the accused. I'm all for naming and shaming when somebody is found guilty, but, prior to that it's just wrong.

As the press were excluded from the meeting it is unlikely that they knew about the meeting. 2 of the offences could have been driving whilst disqualified and driving without insurance. both of these can attract 6 points.

A few years ago I picked a lad up who had lost his license by racing an unmarked police car on the A1M
in Hertfordshire he thought it was another boy racer. The long and the short of it was he picked up a total of 30+ points for numerous offences and got disqualified. It was probably a similar situation where he had been charged with more than one offence at the same time

but it goes without saying if you can pick that many points up should you be driving the public about ?
