Post subject:  Dropped a Major B*ll*ck

We have banned a customer for persistant no pick ups abuse to drivers and owing money this particular customer is an ex driver who is now an alcoholic although now disabled and has been banned by several local taxi firms. BUT

I am now facing losing my license and am being sued by the customer for denial of service and discrimination because apparently unlike when you are on a rank you cannot apparently refuse a request for a taxi over the phone. I mistakenly thought that you can choose whether or not to accept a booking but apparently not :sad: :sad: :sad: :sad: :sad: :sad: :sad:

If what you say in the first paragraph is correct, I don't think you have anything to worry about.

Of course you can refuse bookings over the phone, you may well have been on Holiday, Ill, tired or without a spare vehicle or simply busy....and there is no discrimination in banning a problem customer just like Pubs or Shops can ban who ever they so wish if they cause problems.

You were'nt duty bound to rank rules...

Me thinks your LA's a bunch of numpties.

There is no law, now or ever, that says you must accept a contract, which is what a booking is.

What happens when you run out of available vehicles? Do you get sued for that.

A court will not take this seriously.

You can refuse anyone wether it be on the rank or by a phone booking.

The problem is that I run the only WAV vehicle in town and this is what his solicitor is arguing that under European human rights legislation I have to provide him with a service even though he is not wheelchair bound :sad:

The problem for me is that even though I might well win the case it is probably going to cost me 10K+ to win it and with everything else that's happened over the last 12 months that will bankrupt me

THIS IS LINCOLNSHIRE WHERE UK LAW DOESN'T APPLY THE POLICE COUNCILS ETC CAN MAKE IT TOP SUIT THEM AND THERE ISN'T A THING YOU CAN DO ABOUT IT

He can argue all he likes, but there are 10s of 1000s of WAVs in this country, so the EU aspect will fail.

You have good reason not to pick him up, there is no law anywhere that compels you to pick up this person.

Maybe you should give the WAV to me, and I will lease it back to you for 1p a year.

Yes there is, you can get rid of your WAV. Is that what your council wants, one less WAV?

If however you are really concerned, then there are some licensing solicitors in PHM. I'm sure they can write to the council for you.

Contact them and get a price.

Just go to your local newspaper have a chat with a reporter ,they will love this type of story ,lay it on will make you bankrupt ,only wav in area etc etc unfair council, they will love it , & check with the police if the guy has any ASBOs even contact your local TV news & radio news this is the type of story they want.
