If a ph company provides a Btec 'free of charge' because the funding is provided by a third party, can they realistically make you work for them for a period of time?

Nobody can make you work for them,unless you sign a contract or similar.

They can threatened this that and the other, but what could they claim at the small claims court should a driver leave? :?

That's what I thought. I have a friend who is going down this route and wondered if they could indeed make him work at their company, what he said was if he didn't agree to work for them then he would have to pay for the course.

They could if a contract is signed. And that would have to say for how long you had to work for them after the course, and would probably say that if you left sooner you would have to re-imburse the course fee.

Actually, scratch that. That would be the case if the firm paid for the course (and you signed a contract). If a third party is providing the funding then the PH company makes no loss so they can't insist you work for them (any contract would be deemed unfair). However the third party may require some sort of conditions of work and they in theory could say you had to work for a specific company for a certain time period in order for funding to be provided - any contract would be with the third party.

In short unless a contract is signed no-one can make you do anything, and the terms of that contract would have to be deemed fair and reasonable.

and legal. Just because a contract is signed it doesn't make it legal. The funding will be coming via the government in some form or other.

He might have signed a contract to say he would stay at a certain firm for so long, and the firm could take action to claim the rent for those weeks left of the contract.

However there must be a reason why the driver wants to leave, and does the firm want all that out in the press? :?

And should the court decide the firm is due a certain amount, then do they really want to get involved in a £1 a week repayment scheme? :wink:
