Post subject:  parking fine
On 26 November I received a parking ticket for a wheel being outside the marked bay. I have appealed this ticket stating that there were no signs to say that all the wheels must be inside the bay and that the charge code refers to vehicles in a pay and display car park (code 24) my vehicle was on a street. My appeal has been rejected and if I don't pay by December 26th the full fine of £50 will become payable. However if I pay the reduced fine I am not then able to continue to fight the ticket.
Anyone any advice?

I am assuming that you parked in an on street parking bay. If that is the case then the bay markings would be exactly the same as any other road markings, as they are there for a reason and in effect self explanatory just like any other road markings. The fact in this case that you parked a wheel outside, would be enough to be cause for an offense,

In a similar situation, if your car tail end for example over hangs a double yellow - then you can be done.

To take the yellow line example to the extreme.

If you had say a lorry whereby the wheels fitted in quite nicely, but the tail end overhung by 3/4 feet, then you are in effect within a restricted non parking area, as such a penalty would be imposed.

P.S. Did they state as to why the appeal was rejected?

It is a council issued civil penalty charge and the appeal went to the LCC notice processing centre in Leicester.

Post your query on Pepipoo. If your wheel overhangs the end of the bay, you may have to pay. If your vehicle overhangs the bay, i.e. the lorry with 4' overhang, you are parked within the bay. There may be defects in the road markings, signage, faults with the wording on the penalty charge notice etc. that means you don't have to pay. So far I've had 7 ticket from Shepway and won every one on appeal.

I used to be able to get the wheels of a xlwb sprinter in the box, but the overhang front and back was a bit excessive...

I have been under the impression that if the overhang transgresses into another space thus taking it up, then you are not correctly parked.

Not that Ive seen, but the signs state a maximum weight of vehicle - usually either 2tonne or 3.5t but i never got weighed either, too complicated for them
