Post subject:  who is responsible?
On Tuesday afternoon we were picking up students from school. It had been raining very heavily up until about 10 minutes to home time. The students just come out of school and get in the cars and away we go. One of the drivers rang me to say that as she was dropping off her lot one of the kids told her that he had got the seat a bit wet. It turns out that he had just come straight off of the football field and was still in his soaking kit. The seat was very wet and it has left a stain.
Who is responsible for the soiling charge? is it the parents of the student because their son did not change out of his kit? Is it the school because they failed to ensure that the student didn't get changer? or is it the County council whose contract it is?

You claim off who contracted you, for your losses.

It should be in the contract somewhere.

Surely it's not that bad and a bit of,soap and water with added elbow grease would suffice

The car will have to be taken off the road to be cleaned properly and it will take time to dry. How bad it is, is irrelevant to the time the vehicle will be off the road. At the very least one of the school journeys will be missed which will mean a loss to the company of at least £50.00 plus the cost of the cleaning.

Lol mountain and molehill springs to mind, and how bad it is is relevant if your wanting to make a claim, you've got to expect some dirt will transfer and maybe your driver should have refused the child if he was so dirty

Get one of these, The best £150 I've ever spent and the seats are dry within 30 minutes in this weather, 40 minutes if left with the engine running and heaters on full.

The driver didn't know that the kid was wet through until they got out. :roll:

"any future soiling of vehicles due to student’s attire will be the responsibility of your drivers (not students, parents, schools or LCC)."

I think that's wriggle out of it guff...they are the Customer, they may not be physically in the vehicle themselves but they still are the Customer, whether it was a Councillor, Council employee or in your case School Pupil they booked you for..they are still purchaser in the contract, so it's their responsibility.

I don't think their argument would hold water in court, even less so as they have already agreed to cough up in this particular instance...they are just bullying scare monger's.

Imagine the Hullabaloo if you left said pupil stranded at the School because you barred them from getting into your car in a manky and drooked state. :roll:

The main problem was that the student did not say they were wearing wet clothes. they just got in the car. The driver was on the other side of the vehicle at the time so didn't even see the lad get in. The school have said that he should have had time to change out of his wet PE kit prior to home time.
