the company i am a shareholder driver for dropped our prices 15 months or so ago and its been a huge hit with the punters.because of the extra workload and drivers trying to not do school work they have implemented a rota system.bascically every other week you have to be working 8.30 am to 9.30 am and between 2.30 pm and 4.30 pm if not a £10 fine will be issued. if a 1 driver vehicle works to midnite its exempt from next day. now im not happy about this as im self employed and work the hours that suit me its one of the few benefits to this job. my normal work day is usually 2pm till im done . i know they arnt by law able to enforce a fine but financially im not sure i can fight them. thoughts. |

Wasn't there something about enforced shifts making you an employee, even if you're self employed ? What would happen if you were logged on between those times but just refused all jobs sent to you (unless you want school jobs) ? Unless all drivers stick together and refuse to work enforced shifts and pay any fines there's not much you can do without risking being kicked off the fleet, a shareholders meeting is the way to go and if the bosses won't do what the majority want get rid of them and get some in who will. You would possibly win a court case as threatening someone with an undesirable consequence unless they pay a sum of money (or other threat) could be deemed blackmail/extortion. |

The only organisations that can fine you are the courts and local authorities. See the Pepipoo parking pages for further information. If my "employer" threatened to "fine" me I'd tell him what to do with it; it's an illegal stoppage from wages. If you are "self employed" and he stopped me £10, I'd issue a county court summons for the £10 and then see who's right! |

Its bogus self employment .........rendering the company acting illegally and giving YOU employment RIGHTS.............any fine is an unlawful deduction from earnings........... add just these 2 issues up ...........................the company is now "not fit and proper" ..................you want more assistance advice representation...............join a UNION ..........................or get mugged off.......................i know what my moneys on
