If your driving a Private Hire Vehicle and parked outside a busy night club venue on a weekend night and at closing time Customer approaches you and you let them get in without a booking, then radio through the office and book the job?
Is this legal?

Very hard to defend once they get into the motor.

So I very much doubt that would be viewed by a court as legal.

You have a phone and/or a radio/PDA, you tell the base to take the booking BEFORE they get in the car, with me i wait till i get the job on my PDA and let them in the car

BUT WHY ARE YOU --- A PRIVATE HIRE CAR ----- PARKED OUTSIDE A BUSY NIGHTCLUB?

Probs gone there and the customer has already jumped in another cab/ph car. Round here drivers will take longer fares without thinking about it rather than waiting for correct booking. Thus quite regularly on a busy night it can become a free for all arriving at busy pubs.

Plus there are no hackneys around in the nights, and no enforcement, so everyone is at it.

Has anyone ever been convicted of plying for hire based on cctv evidence?

Anyway doesn't matter to Me as I always ensure the correct passenger gets in....

the OP is in Aylesbury, so not as safe as he thinks, cctv or no cctv

Quote:
A taxi driver faces losing his licence after being prosecuted for operating illegally.

Sayfur Rahman, of 70 Aylesbury Road, Wendover, was caught plying for hire in his private hire vehicle, which should only pick up pre-booked passengers.

The offence came to light during a test purchasing operation in Aylesbury town centre involving officers from the district council’s licensing team. Licensed private hire drivers were approached, without prior booking, and asked to take officers to previously set destinations.

Rahman was caught after picking up two plain clothed officers outside Sainsbury’s in Buckingham Street and agreeing to take the passengers to the Watermead Inn, where they were met by an officer from the council’s licensing department. The defendant was cautioned and questioned by the officer.

Quote:
AYLESBURY Vale District Council has successfully prosecuted a private hire driver who was found to have collected a passenger without a prior booking.

Mr Abid Shah, of 13 Havelock Street, Aylesbury, pleaded guilty at Aylesbury Magistrates' Court yesterday (10 January) to plying for hire and was fined 200. He was also ordered to pay 200 in costs and a 'victim surcharge' of 15, which goes towards support services for victims of crime and witnesses.
