last August I was involved in a non fault collision. The other driver has admitted that he caused the accident and this has been accepted by his insurers.
However, his insurers are refusing to pay out on the claim because they say that the replacement vehicle provided by my insurers was in their opinion, to expensive and was hired for to long and the hire was not necessary. They are even questioning if the both our vehicle and the hire vehicle were licensed, if I was licensed to drive the vehicle if both vehicles were insured for hire or reward. They also want to know exactly what work our vehicle was doing for the month prior to the accident, what every other vehicle in our fleet was doing after the accident and my last 3 years accounts.
What a palarva.

I rang the firm of solicitors a few minutes ago and it turns out that my broker has handled everything and not my insurers. I am about to ring the broker now.

EVERY single third party will fight the cost of the hire vehicle.

This is always a case of, you should have used a cheaper alternative.

Brush it off. Let them fight it. ATEOTD, you were given a vehicle that was fit, and as long as you didn't get a stupid sized/priced vehicle as a replacement. You will be fine.

As long as liability was accepted by the third party. The vehicle is not your problem to sort out.


FWIW. Insurers. Especially no win no fee. Will charge extortionate amounts per day for the hire car so as to squeeze extra money out of the other side. Always have. Just like the physio costs.

Apparently the vehicle hire is not part of the insurance policy. they say that you can't get a courtesy car for business use as part of any policy.
it comes under uninsured losses and this is not dealt with by the insurer but a claims handling company. The insurer covers the recovery of the vehicle and the repair of the vehicle.

If your fully comp your insurance company should deal with everything. Brokers are so 10 years ago.

this is why id hire a base car, get an invoice and pass it on......fck em then they can argue but £320 a week is cheaper than a plated courtesy/hire car from the ambulance chasers

The last time I had a no blame claim my PH stayed off the road until fixed (About a week) and I received the equivalent of a weeks worth of lost income based on the last 6 months average fare income...but that could be the worst 6 month of the year.

Insurers should by law be made to make it crystal clear in their policy before you buy what your going to get, they speak in terms that are ambigious at best and completely incomprehensible at worst

lets be right, the whiplash and plated car hire are the very things that have pushed up premiums fot the taxi trade

They are only paying the local rate here....200 to 240 per week not £100 per day, One lad has just had to pay £4000 himself to the car hire firm..

In most cases, where there is an accident money doesn't even change hands, insurance companies simply accept their own losses, rather than going to court to fight it out. #-o #-o #-o #-o #-o

And they hike everyone's premiums to compensate... #-o

It probably does not help (an understatement) but you also have to realise that the Insurance industry is as bent as a nine bob note. They will look for any little teeny weeny info to partially blame both parties.....and hey ho we can hike up the premium for BOTH parties.

Part of the problem lays with them when they decided almost en bloc not to "If possible" get involved in litigation as it is very expensive. The downside of that is that they deal with each other (probably on a friendly basis) and see what they can both get out of it in financial gain and financial damage limitation. During that period some companies have gotten into the stride of paying silly money for cab/car hire.........now they are it would seem - waking up.

I have just had an email from the solicitors. It looks like this claim will be going to court. The claim is for £16,000 and the costs are now £7,000.
