How do you get a driver who is doing one with the commission? I didn't have a writer agreement with them, so my bad.

While we are on that. Do you have or know a template agreement for ph drivers driving operator vehicle that covers this kind of scenario?

There used to be a time when men could be trusted by other men. Bloody feminists screwed us over.

Do you have any tips on the second part of the question?

Maybe you should have taken a bond from him to secure against such things.

Thanks grandad. Thats some good point right there. He was desperate for a job and I thought he could do with a good heart. Maybe I was wrong, now i know I was.

Is there anyone with an example agreement that i could copy/modify to suit this kinda situation?

Just a CCJ through the small claims court.

If you are a menber of the FSB then their legal helpline can provide a lot of help in matters like this but to be honest the main reason why most businesses have fixed board rents and not commission is for this reason. The only way to avoid fraud is not handle cash like uber does

Thats what I did. Should I name and shame him so other operators know about it? Should I inform his new operator?

Just be careful what you say and do!

Stating the obvious.......knowing and proving are two different things. However a discreet word in his new employers ear i.e one on one....followed by... you will deny it if it is repeated, might make you feel a little bit better.

A lesson to us all.

Get him to pay daily, either through the letter box or hidden in the car somewhere.

That way you are only going to get bumped for a days money.

In terms of a contract letter just put the basics down and get him to sign and date it.
