Carriage of goods in a Hackney Carriage?

Post subject:  Carriage of goods in a Hackney Carriage?
Our drivers association have been to a meeting with the Council this morning to discuss fees and a revised policy.
The policy states that we are not allowed to make any unoccupied charges. The question was asked about how we go about charging if someone asks us to take a package from A to B without there being a passenger present. The Council officers reply was that we are not permitted to carry packages in a Hackney Carriage. We are only permitted to carry passengers and their belongings.
Anyone else had this one?

No, no, no! The officer stated that we are not allowed to cary unaccompanied goods. There must always be a passenger in the vehicle. I have had the discussion with her before and she mentioned the insurance angle then. I checked with our insurance company at the time and they stated that the insurance was not an issue unless it was a regular contract in which case GIT insurance would be required but would probably cost nothing. But she is saying that regardless of the insurance we can't carry anything other than people.

Grandad,

TP Clauses 1847,section 54,does not refer to a person as a fare,but refers to any job,the carriage has always been able to be hired without the need to carry a person.

I would argue this point.

Firstly insurance.... your H&R should cover you as a PRIVATE carrier (passengers goods) not a COMMON carrier, check

GIT..... check if you have it

Your council are getting beyond themselves, we deliver bouquets of flowers, sometime 3 drops so 3 x meter fare.....lol

GIT is cheap, I used to have 3 LWB vans on a Norwich Union Freight policy, £10M cover for £150 a year

Had to deal with this a few years back. Local parcel delivery service tried to make out it was illegal to carry parcels/packages, so legal opinion was taken by Sefton council. If a hackney was to solely pick up and deliver packages then there would be an argument to revoke the licence, but seeing as hackneys mainly carry passengers and only a small amount of work is derived from delivering parcels then there is no problem. You need to ask your licencing officer which Act is she using as authority to formulate her opinion. As most hackney and ph drivers will know the National Blood Bank uses the taxi and ph trade for the urgent delivery of blood, which is a parcel. Is she saying this must stop? It is always advisable for licencing officers to get legal opinion before they start spouting such piffle.

section 75 1976 act


75 Saving for certain vehicles etc.


(1) Nothing in this Part of this Act shall—

(a) apply to a vehicle used for bringing passengers or goods within a controlled district in pursuance of a contract for the hire of the vehicle made outside the district if the vehicle is not made available for hire within the district;

Its obvious the 76 act envisages vehicles bringing in of goods into a controlled district.

sometimes I'm just wondering what kind of hard life you guys must have finding problems in no problems area, trying to complicate your own lives and work which is linked to it... maybe I'm just an ignorant but all above doesn't apply to me and never even asked if I can deliver blood samples (which is a regular job since I remember) or envelope with council's !!! documents... or suitcase between two houses.... why you always trying to find hole in a solid plate? how about food delivery or just shopping? still need to find something making live harder to you and your customers?

I think it is the jobsworths at the councils not ourselves trying to complicate things
