is a council aloud to put a age restriction on vehicles or as there been any case law saying they cant do it

DFT best guidance reminds Licensing Authorities that it is perfectly possible for an older vehicle to be in good condition and that setting an age limit beyond which they will not license vehicles may be arbitrary and disproportionate.

Yes, as long at it's a reasonable restriction.

Only a court can determine what's reasonable.
