I successfully challenged the late Shepway District Council on an existing vehicle and won. Providing the vehicle is in exceptional condition.

I had a 55 plate Voyager, licences it when it was 2 years old, their age limit was I think 7 years. I had the car regulrly erviced and it was in very good condition, challenged them in Dover Magistrates and won. The LO was apologetic and agreed with me but had to go all the way with the case to prove to the councillors their rules actually broke the law!

Fought ours but 1 official insisted no chance beyond 7 years

2 weeks later they caved in, we have had paintwork and wheels done and have passed 3 so far, last time the senior LO said "well, its in the regs for all who read them" 8itch

Quote:
"Licence applications for vehicles in exceptional condition which are outside of the Council's policy, for example by age and type of vehicle, will be subject to additional checks relevant to the type of vehicle. Applicants must provide a council approved independent automobile engineer's report for vehicles outside of the Council's age restrictions. This report is in addition to the Council's mechanical inspection to indicate that the vehicle is in immaculate / exceptional condition. An additional fee will be charged for vehicles outside of the Council's policies to cover additional administration (See Schedule of Fees)"

I'm pretty certain my case is on here in the legal section, Shepway District Council-v-Gould at Dover Magistrates Court, I can't remember what year! Maybe 2012.

I've got a feeling my case went to court but the LO offered no evidence based on the 1982 Nottingham case in the Hight Court. Link here to my earlier reference, I don't know about the link to the Nottingham case. Maybe do another search on here, that's where I would have got it from.
