Looks like I will be an Ex taxi driver as of tomorrow

Post subject:  Looks like I will be an Ex taxi driver as of tomorrow
18 months ago I had an insurance approved repairer take over a month to repair some accident damage one of my drivers put on a back wing. The result was the vehicle did not make it's due test date we informed the council that was the case and then contacted them again to say it was in for a test and was told sorry but we can't re plate it and issued me with 6 penalty points on my license :roll:

a year ago I put a vehicle in for servicing 3 weeks before it was due it's mid term compliance test the garage damaged the engine and resulted in an extensive rebuild of the engine at vauxhall main dealer. Council were notified but it meant the vehicle missed the "due date" as soon as repairs completed vehicle was booked in and passed but council still issued me with 6 points even though I could do nothing about it.

Vehicle missed it's due date by 12 hours because some tyres due to be fitted on the 31st did not get done till 4 April because tyre place was too busy and nearest appointment available for testing after that was friday am.

Naively i assumed that as this was less than 24 hours the council would allow some leeway but no they have written to me stating that I am deemed not a fit and proper person due to an mot due by date being slightly missed and have to attend a formal disciplinary hearing tomorrow and have been told to expect to be stripped of my badge :sad:

There are local drivers pulling all sorts of stunts every day such as overcharging or taking people the long way around forming unofficial ranks in non designated areas. making indecent comments and proposals to customers but this is not touched but because i could not get a vehicle through it's test dead on time and they can sit in an office and check that a date was wrong I am being thrown to the wolves

The councils always have to have policies that are reasonable. Ask them at the meeting what policy they have in place that allows for things to happen that are out of your and their hands. for instance, a vehicle is due for test, and shortly before the test date it is involved in an accident. The car goes to the repairers, a part is not available, so it cannot be repaired until after the test date. Ask them what policy they have in place that is fair to the drivers, and if they haven't got one, why not, because many councils do.

I have always said to drivers, appeal against any penalty points issued because it is not the first ones that get you or even the second ones, it is always the last ones.

Who is the person or persons preempting a disciplinary hearing decision.
This can be construed to be an abuse of power,threatening behaviour by those making those comments.

Didn't you used to complain at the lack of enforcement by your lot? Now you are complaining at too much enforcement.
Tell them that they are being unreasonable and if that fails Rutland is not far away. :wink:

Take a solicitor with you ..if it goes against you appeal straight away..so you can keep on working...it will get thrown out...

See if you can get the meeting put back as you need legal representation and in the meantime transfer your vehicle licence into the wife's name, but I don't think a magistrate will deem you not fit and proper, you notified them at the time. The MOT was a bit naughty though. Off with his head.

No I'm not I'm saying that they are not using logic and common sense and are enforcing from the comfort of their desks instead of catching the ones who persistently get away with using the taxi rank as a car park.Who form unofficial ranks where they shouldn't along with the cherry pickers and the ones always taking people the long way around or charging tariff 2 4 hours before the tariff card says you can nothing is being done about that

There was no reasoning with them there attitude was i should have shut down my business for a week and spent it touring Grantham trying to find a garage who could do a same day or next day test.

What really upset me though was they claim there was no record of me telling them about the car stuck in the garage the previous occasion and one of my drivers remembers being stood next to me during the conversation

and apparently their system is infallible !!!!!

I now have to be interviewed by a manager which will be another wasted day and then put before the committee to be stripped of my badge. There are two offences that they treat as severe one is not getting a vehicle passed by due date and the other is bouncing a cheque on the council which is also a 6 point offence

They were demanding an action plan by me which guaranteed that all vehicles be tested at least 4 weeks before due date to guarantee nothing can go wrong

in other words test my vehicles every 5 months instead of every 6

couldn't give a stuff I am plated by a council that won't do anything about sexual harassment of female passengers,overcharging,touting because the offenders are from an ethnic minority but to prove they are being proactive target people from a majority ethnic background who accidentally bounce a cheque on them or stick with their regular MOT test station instead of cart the vehicle 25 miles up the road on a hope and a prayer.

I just don't believe in it I would prefer to be within a couple of weeks of the original test date so that I don't end up with a 7 month interval between tests or the certificate being unacceptable when road taxing my vehicle because the expiry date is too close to the end of the month :wink: If you get it done too early you can end up with compliance certificate running out before the road tax and the post office refusing to accept it

And also according to schedule J of their licensing conditions the maximum points for the offence is only 4 but i got given 6 for both offences !!!!!

no doubt they will claim it is a different offence
