Post subject:  What a ridiculous thing to quit over

Today I had a driver quit his job and walk out on us why because his seats had mud on them and i asked him to wipe them down with a damp cloth to clean them

he's missed out on a very busy morning and was due to do a Heathrow this afternoon all because I asked him to clean his car :roll:

It's a good job you didn't ask him to stop smoking in his car as well.

We had one walk out because he took exception to being asked to address his poor personal hygiene issues

firstly this one doesn't smoke

secondly it is HIS car

thirdly this has been an ongoing bone of contention because there have been customer complaints but he simply will not keep his car clean. He has immediately gone in with scumbag cabs who do a lot of work out of the George so whats the betting there will be more complaints there or some expensive bills for dry cleaning !

I know it is difficult to get and keep good drivers but are drivers who either smoke in their cars or don't keep them clean and tidy really the sort of drivers that you want? I would rather be short of a couple of drivers than have drivers like that ruining our good name. Let them ruin someone elses reputation.

So you can't tell a driver to comply with the law regarding the smoking ban because he's self-employed, yet you can micromanage another self-employed driver's behaviour with regard to the cleanliness of his car? :badgrin:

Not sure what you are getting at the driver who smoked is asked at least twice a week not to and has now finally taken it on board and gets out of his car to smoke the other was asked to clean his car and went off in a huff that is not micro management that is asking self employed drivers to show some respect for the people who pay their wages i.e. the customers

What I was getting at is that one big element of the self-employment/employee thing is the *extent to which the driver is controlled*. Not conclusive, but if you're telling the driver how clean his car needs to be then that's an argument in favour of the driver being an employee.

It's a bit like company uniforms and the like - if you're micromanaging what the drivers wear then more likely to be considered an employee [-(

I disagree with that I think even for self employed people your customers have a big say and complaints coming through you need to be relayed to the drivers being complained about

Can't disagree with you, but we're sort of arguing the thing from different perspectives.

I mean, if a PH firm said to a judge that the drivers had to wear a uniform and charge prices dictated by the firm then that would point towards more control and thus more likely to be considered employees by the court. Don't think it would matter if it was claimed drivers had to wear a uniform and charge the same prices because it was good for business - that's not the angle the courts would be looking at.
