We have a chap who wants to come and work for us. He has filled out all the forms and paid all the fees. However the Council put his wrong address on the DBS application and it has gone astray. The DBS people posted it out on 15 November but he had to wait 3 weeks to order a reprint. It was only then that it was found to have the wrong address. He has to go back to the council today to get a new form filled out and the council are paying the fee. The thing is the delay has stopped the chap from working so could he have a claim against the council for loss of potential earnings?

No, the officer fills in the form. It has happened on more than one occasion.

Do you not use the electronic system of filling the form in yourself and get a ref.number for the Council to enable it to be processed.

I filed my check with the DBS at 11.20 am. gave the Council the ref.number at 11.40 am. was informed by the Council at 4.20 pm. that the DBS check was clear.

done and dusted in under 5 hours.

Don't be daft. Our council use the DBS application to have a one to one with the applicant so that they can check identity and other things whilst filling in the form.

Yes.

Easiest way is via the Local Government Ombudsman.

But first make a complaint to the council asking for compensation.
