Gary Smith claimed he was entitled to more than £74,000 in holiday pay accrued over six years. In a landmark victory he has won his case at the Court of Appeal - meaning thousands of other Britons could now follow in his footsteps.

When Mr Smith started at Pimlico Plumbers he was self-employed, before later being taken on as employed staff.

During the six years that he was employed he wasn't given holiday pay which he has worked out amounts to £74,000.

The plumber previously had his claim rejected at an employment tribunal, however this has now been overturned at his employment appeal tribunal.

It's a significant ruling that could lead to many more Britons taking former employers to court.

most of our local plumbers will only do boiler jobs at £3000 + a time the boiler only costs £500

many openly brag at doing 60 to 70 boiler installations a year 5 of them live in houses worth over a million

oh and if you phone them looking to get someone in to do a small job you won't get a reply

The fella has always been self-employed, but since that mob lost at the courts, akin to Uber and AL, the plumbers have been given workers status. Hence the confused comments above.

The issue the SC decided on wasn't whether or not the fella was due holiday pay, it was for how many years he was eligible for it.

The firm said it should be just one year as all the other years he voluntarily didn't take holiday, he worked through it and got paid for that work.

The SC decided that unless the firm had written to him, saying that unless you take your holiday it will not be rolled over, which they didn't, then he was due all those years holiday pay.

A few years back we actually had an operator down here promise drivers with 8 seaters that they would take £3,000 a week. ](*,)

Holiday pay is worked out over the total hours you work. So overtime hours should be counted in the calculations. In all the time I worked in engineering I never once had overtime taken into account. What chance do you think I have of making a claim against all my former employers?
