Was going to put this in the non-taxi news section, as it's from the US. But as it is taxi news that would be a bit strange, hence the new non-UK taxi news topic. 8-[

Not recommending any of us follow this fella's lead, but also not sure many of us will have much sympathy for the punter. :-$

No paywall for me, and be in no doubt I never pay for any info online.

Basically they are just highlighting the problem emergency services have, and no doubt will have in the future, with driverless cars.

How will these cars know when to get out of the way? :-k

99% of drivers are flocking clueless when they see (if they see at all) blue lights behind them.

A yoga class was interrupted by police after a member of the public saw several people lying on the floor and reported a "mass killing".

Managers at Seascape Cafe in Chapel St Leonards, Lincolnshire, said officers descended on the building on Wednesday night after the alarm was raised.

They sought to reassure residents and thanked police for the prompt response.

Lincolnshire Police confirmed everyone was safe and well, and the call was made with "good intentions".

The Seascape Cafe, based at the North Sea Observatory, said on Facebook: "If anyone heard the mass of police sirens in Chapel St Leonards at 9.30pm last night then please be reassured.

"They were on their way to the Observatory after someone had reported a mass killing in our building, having seen several people laying on the floor... which actually turned out to be the yoga class in meditation.

"Thank you to Lincolnshire Police for their prompt response. I can't imagine for one moment what would have being going through their minds on the way."

Uber warns of threat to drivers under EU gig work plan

A top Uber executive has warned that Brussels’ proposals to designate gig workers as de facto employees will force its ride-hailing service to shut down in hundreds of cities across the bloc and raise prices by as much as 40 per cent if enacted.

Anabel Díaz, head of Uber’s mobility division in Europe, urged lawmakers debating the EU’s Platform Work Directive this week to approve rules that preserve what she described as self-employed workers’ desire for flexibility.

“If Brussels forces Uber to reclassify drivers and couriers across the EU, we could expect to see a 50-70 per cent reduction in the number of work opportunities,” Díaz said. This would cause Uber to cease operating in “hundreds” of the 3,000 cities across the EU that it serves today, she added.

A new law giving drivers full working rights would also force Uber to raise the prices paid by consumers, Díaz added. “It could drive up prices by as much as 40 per cent for consumers in major cities — according to the European Commission’s own estimates — and with fewer drivers, riders could expect to experience significantly longer wait times.”

Her comments come in the week that the EU’s main institutions — the European Commission, the parliament and the Council of Ministers — have kick-started negotiations over the final text of the new law, which is aimed at improving economic conditions for gig workers in the bloc.

The law is likely to represent a significant change from the status quo in Europe, where the majority of platform workers are presumed to be self-employed, meaning they lack access to labour rights and benefits, such as paternity leave and a minimum salary.

Speaking to the Financial Times, Díaz warned of the consequences of the proposed EU legislation, which would give people who work for digital platforms — including drivers for ride-hailing services and food delivery drivers — the rights of full-time workers by default.

She said Uber is “sincerely committed to the European social model” but warned that similar rulings classifying drivers as employees in Spain and Geneva have led to “devastating” job losses.

“In order to manage the costs of employment, Uber would be forced to consolidate hours across fewer workers,” she said. “Drivers and couriers would need to apply for an open role, if one is available; show up for shifts at specific times and places; accept every trip they receive; and agree not to work on other apps.”

Díaz denied, however, that changes in the law would hit Uber’s profitability in Europe. “This isn’t about Uber’s profits,” she said. “We have already proven our ability to grow in places like Germany and Spain using a third-party employment model.”

In Germany, Uber contracts fleet management companies, who employ their drivers, in order to operate under local rules. Uber says its prices are higher in Germany as a result and its ride-hailing service is only available in major cities where it can expect a steady stream of demand.

In the UK, following a high-profile court ruling in 2021, Uber operates under a different model: its drivers are designated as “workers”, entitling them to benefits such as holiday pay and sick leave, while falling short of full employee status.

Despite the warnings from Uber and rivals in the sector such as Bolt about the proposed platform worker rules, EU officials have pushed back at what some see as the tech industry’s lobbying tactics.

At the launch of the EU’s proposal, Nicolas Schmit, EU commissioner for jobs and social rights, said: “This is about establishing clear criteria and looking at the facts. If the platform is in fact an employer, then the people working for it are entitled to the same rights and protection as workers in the ‘offline’ world.”

Garda who drunkenly assaulted and racially abused taxi driver sued in High Court

A garda who drunkenly assaulted and racially abused a taxi driver while trying to seize his vehicle is being sued in the High Court.

Dylan O’Loughlin called the driver, Mohammad Ali, who is from Kuwait, “scum” and “a black c**t” and took his car keys during a dispute over a fare, court papers state.

They go on to say Mr O’Loughlin produced his badge during the incident and identified himself as a garda before grabbing Mr Ali by the neck, pushing him against the car and threatening to kill him.

Mr Ali is suing Dylan O’Loughlin. He is also suing An Garda Síochána as an organisation, claiming it is liable for Mr O’Loughlin’s actions as he was claiming to act under Garda powers during the incident.

The matter has already been dealt with in the criminal courts following an investigation by the Garda Ombudsman Commission.

In March, Mr O’Loughlin, who is from Donegal but was stationed in Swords, Dublin pleaded guilty in the District Court to public drunkenness, threatening and abusive behaviour, assault and interfering with the mechanism of a car in Clonee, Dublin on August 15th 2021.

He pleaded guilty but asked the judge to not impose a conviction as it would cost him his job as a garda. Judge Gerard Jones called his behaviour “utterly reprehensible” but agreed to strike out the matter, leaving the garda without a conviction, on condition he paid €5,000 to charity.

He was suspended after the incident. The Garda Press Office would not confirm if Mr O’Loughlin remains a member of the force, saying it “does not comment on internal disciplinary matters”.

The incident began just after midnight when Mr O’Loughlin and a female passenger got a taxi from Swords to Ongar Park. The garda fell asleep on the journey and when he awoke he insisted on paying by card.

After Mr Ali informed him he did not have a card machine, Mr O’Loughlin began to insult him and called him “scum”.

Mr O’Loughlin took out his badge and said he was a garda before getting in the front seat of the taxi and going through the glove box and examining the receipt machine, according to court papers seen by The Irish Times.

He pushed Mr Ali and threatened to arrest him before saying he was going to seize the vehicle. He allegedly repeatedly told the driver he will lose his licence and insisted on inspecting the boot for a fire extinguisher.

Mr O’Loughlin then sat in the drivers’ seat and took the keys, meaning Mr Ali was unable to leave. The driver suggested they go to a Garda station to resolve the matter but this was met “by an onslaught of verbal abuse and racial slurs,” the High Court claim states

When Mr Ali asked the garda to get out of his car, Mr O’Loughlin followed him down the road, grabbed him by the neck and pushed him against the car. He then allegedly threatened to kill the driver and made more racist remarks.

Mr Ali managed to escape the garda’s grip before running away and calling Blanchardstown Garda station. Garda arrived and arrested Mr O’Loughlin, who made another racist remark, the papers state.

Mr Ali, who is represented by Mulholland Law, states he was left in a “state of fear” after the incident and that it caused him significant stress and anxiety. He said he stopped working full-time afterwards.

French taxi drivers sue Uber over unfair competition

Around 2,480 taxi drivers will embark on another round of their latest legal fight against Uber in Paris on Friday accusing the American giant of unfair competition as they seek around 455 million euros in damages.

Uber has had to battle a slew of legal challenges in the 12 years since it first began operating in France and this latest one pits them against some eight percent of the French profession with the plaintiffs backed by nine associations and unions out to secure victory over Uber France and Uber BV.

The French drivers launched the action in the wake of an earlier court of cassation decision recognising the existence of a relationship of subordination between the Uber platform and one of its former drivers.

The court on that occasion determined the driver had a contract of employment with the platform rather than freelance status.

"By refusing to apply French labour and tax law, Uber is therefore indulging in unfair competition," the taxi drivers' representatives maintain.

They added they "intend to demonstrate that Uber has set up a system where illegality has been established as an operating principle, a system where violation of the law is used as a way to trample over the market, to the detriment of competition," one of the drivers' lawyers, Cedric Dubucq, said.

The drivers believe they are each out of pocket annually to the tune of 9,300 euros per year and also want damages and interest from Uber, which says the action is unfounded and "anachronistic".

"Today, more than 35,000 VTC and taxi drivers use our app to generate revenue. This action goes against the interest of an entire sector and drivers who wish to remain independent," an Uber spokeswoman said.

In a different case, the Paris Court of Appeal earlier this month ordered Uber to compensate 149 taxi drivers over unfair competition linked to the activity of its former app UberPop.

Uber have done that from day 1 worldwide and no government national, local or regional has managed to bring them to heel. I somehow doubt this latest in the thousands of legal challenges Uber has faced will succeed
