Can anyone please tell me the rules on fare fixing, as a Hackney do we have to use the meter when going out of our area, or can we agree a price, treat it as a private hire booking get the money up front and then go.

The case in point is as follows, a driver told a customer he wanted £50 for a journey that would usually cost £22, as it was 3am and the punter wanted to get home they paid the money, then complained the following day, the driver says that as they paid him that means they had agreed the fare and he has done nothing wrong, we have told him that whilst in criminal law he maybe has not done anything wrong, morally he has committed a sin.

"morally he has committed a sin".

Tell him to say 10 hail mary's

Of course if you take the p*** you could be questioned by trading standards, and in a few areas they are the same folks as the licensing team.

Thank you but section 65 seems to say one thing and 66 another so in plain simple terms that a woman can understand, can you or cant you set a fare or must you use the meter

Sec 66 says you must use your meter if you don't agree a fare before you set off.

The use of the meter issue is a little difficult, so if you do agree a fare before you leave, then just put your meter on to show the customer what a good deal they have had.

Unless of course the final fare is more?

That's understandable considering they are two different provisions.

Section 65 provides for the setting of fares within a licensing authority and section 66 provides for the offence of overcharging a passenger who has not been informed prior to undertaking a journey ending outside the prescribed distance of the licensing authority, that such a charge would be over and above that which is displayed on the meter.
