anyone help with this scenario a p/h driver takes a fare to liverpool. the passenger doesnt know the right address so after a few laps the passenger says she can phone someone who knows where it is. the passenger cant understand the person so says tell the driver and passes him the phone. hes driving and plod see him and give him on the spot fine£30.00. its his fault he should know better . he going to pay the fine but when hes checked the ticket its details are wrong ( ticket says its a ford galaxy but he has a vw sharran ) . all other details correct q: can he appeal and is it worth trying

In a word, No. He was still driving a vehicle whilst on the phone. And if he contests it, and loses then he'll get costs as well. Was it one of our's? or a St Helens phv? And it's going up to £60 + points!! |

If the ticket's not correctly written then the chap has had a result.
If it was correctly written then the lad should just have paid and been grateful for the fact that as he had customers in the motor it didn't lead him to be charged with driving without due care and attension.

I f the ticket said mini and it was a ford cargo maybe so. Ive read of wrong reg numbers being written and they havent got away with it. |

If you look it up you will find he has got away with it, If the police write out the ticket all details must be correct, If it goes to court it will be thrown out strait away for wrong details, tell him to keep his money in his pocket and wait for the summons which more than likely will have the wrong make of car on it as well, he should go along with it and when the prosecutor asks him if he is the owner of a ford galaxy all he has do is say no, and not say another word, and when the judge asks just say I do not own a ford, tell him to take the log book with him and only allow the judge to see it, and when he sees that its a VW he will throw it out then your mate can claim a full days compo for taking the day off There was a drink driving case where the driver got off all because the police did not put a fresh tube on the meter for a second test attempt |
