Post subject:  Taxi "written off" by uninsured driver
Hi there

I would really appreciate some advice from anybody please?

My son owns a black cab, and we share its use. We are both fully liscenced and insured. My problem is that whilst I was out working last night, another car crashed into my cab. The driver and passenger of the vehicle both got out and ran away!! My sons taxi is now a write off, which means that we are both now unemployed. There were no serious injuries, but plenty of witnesses.

I am devastated, the car was driving at such a speed taht it left me dazed, but it looks as if the driver of teh other vehicle was either uninsured or under the influence of alcohol or drugs.

This is a terrible situation, and what I want to know is if I can claim compensation of any kind from anywhere? :shock:

Sorry to hear this and Yes there is a company that has been set up to compensate people in this instance, however i cant remember the name of it at the moment but i will sure do my best to find out and post it asap unless of course anyone else knows the name and details of said company!!

I have found the info for you.

You need to vist the Motor Insurance Bureau website at www.mib.org.uk and click on accident claims then submit a claims form.

If you are insured and the police are involved, then surely you'd be best advised to contact your own insurance company?

In my experience of this matter, the insurance company simply washed their hands of it!!

But if you were fully comp then I presume they wouldnt, and I suppose they would always give advice if you were TPF&T ?

If you have fully comprehensive insurance, then the MIB will probably tell you to claim off your own insurance. You would be better off seeing a solicitor, if you were in the car at the time you are eligible for a whiplash claim, if you wear then :wink: the solicitor would piggyback your claim for damages on your vehicle, damage to the vehicle usually end up with you paying the first 300 pound, it must be reported to the police.....

An NFA with witnesses, you should be back on the road in a hire cab by Monday (provided your fully comp).

all these claim companies only help if they have a 3rd party to claim against to recover their costs.

check your policy to see what your covered for.
if it says your guaranteed a replacement vehicle then your ok, if not they will normally only supply you with one if they have a 3rd party to claim the costs against ie a 3rd party at fault.

if the owner can be traced then you should be able to claim against them.
they will have to name the driver.
and if they cant their only alternative to stop you making a claim against them in a civil case is state the car as stolen...?
if they name someone who isnt on the policy but driving on their own insurance you would claim against that. if their not insured at all the only thing you can do is take them to a civil case..!!
someone on here will know the ins and outs of that if its the way you have to go...!!

i know a solicitor in swansea who specialises in only in taxi / ph work
used to write for the mag last year...!!

will dig his phone number out for you. he's covered this sort of thing in the past and he'll give you some free advice for sure.
just say Tony Mite at Press Cuttings Monthly gave you his number etc...!!
