Hi

I have often heard conflicting news regarding whether Taxi Drivers are required by law to wear seat belts. Can someone please explain some facts.

I obviously know that it is the safety of the Driver to wear the belt, especially for example on a Motorway. But am I right in saying the driver can not wear the belt at all time? or is it just in the licensed area. Plus is it for Hackney, or PH as well? This would be interesting as in my area it is fairly difficult to know if a PH is a taxi sometimes, especially of the magnetic stickers have fallen off.

I must admit I have fallen into an awful habit of not wearing the belt, just wondering if I should attempt to change that?

i always thought ph's and hack's don't have to wear one if they have poeple on board, but if there's no one on board the ph's must wear one, and the hack's outside there licinece area :)

EXEMPTIONS-
the driver of—

(i) a licensed taxi while it is being used for seeking hire, or answering a call for hire, or carrying a passenger for hire, or

(ii) a private hire vehicle while it is being used to carry a passenger for hire;

SO IF YOU ARE PH YOU ARE ONLY EXEMPT WHEN YOU HAVE A FARE.
IF YOU ARE A HACK YOU CAN GET AWAY WITHOUT WEARING IT ALL THE TIME.
THE POLICE HAVE STOPPED ME A COUPLE OF TIMES AND I HAD TO EXPLAIN THE LAW TO THEM AS THEY ARE NOT SURE HALF THE TIME.

wearing a seatbelt with passsengers on board can be MORE dangerous than not wearing one. i found that out the hard way

Just to clarify the above point if a Hackney is not available for hire i.e. your on your way home after your shift or you are using it for private use such as going to the supermarket etc. you are NOT exempt however if you leave your meter on and your for hire light showing then you are technically AVAILABLE for work which complies with the law
