one of my daughters keeps getting demands to take money out of her bank for insurance of her car

she finished with her last insurers on 20 May and went to a new insurance comapny

i paid the insurance premium in full for her with the new company

the old insurance company says that she is not insured as per the data base, whether that be their data base, but on this link its says she is covered

she got in contact with the old insurance company and told them that she has new insurance cover and dont need their services anymore, but they still keep trying to take payment every month but unable to do so as the direct debit is cancelled

the old insurance company are asking her to show proof to them that she has new insurance cover until then they will keep trying to draw direct debit payments but they are unable to draw off from her bank as its cancelled after she changed insurers

i have told my daughter you are insured, you have the policy and ignore the old insurance company

the former insurance company are saying to her it is illegal to have 2 policy's and they are unable to cancell their policy which was took out and paid up in full, when that ran out she went to new firm

my thoughts to her are ignore them, but she keeps getting letters of demand

Old company are taking the p*ss. They can't insure anyone against their will. They also have no right to any information about who she is insured with now. Just make sure any certificate of insurance has been returned to them and the policy cancelled. (Send recorded delivery) Then tell them to GTF.

Just to clarify:

What date did the old insurance expire? Did they take any premiums by DDM after the last payment was due on the old policy that could conceivably accrue to a renewal of that policy?

Provided Askmid shows the vehicle insured and you have a valid certificate then tell them to foxtrot oscar. Also advise them that further contact will be considered harrassment and appropriate enforcement action may follow.

answer to frst paragraph.......... NO, but they tried to continue the insurance, it has some small print saying if you fail to contact us when the policy runs outs it will be considered that ongoing insurance is required and will be continued and payment due

what they are saying is that you cant be insured by anyone else or have another policy because we seemed to have you trapped by some small print, that you failed to contact us, and as we are your insurers we are continuing to seek payment until we see your new policy document, then and only then will we waive the contract, but a charge will be outstanding for this

the policy from the old insurance company expired 20 May 08, my daughter sorted out the new insurance online on the 16 May o8, Dad paid for it as usual

this is the old company of insurers, link below, she dealed with before.........
they charged her 760 odd quid, as a new driver, she's 27 years old but only past her driving test 1 year ago, this year after 12 months experience on the road, the best quote to which she searched the net was 350 quid to which she is with now

My contract law is rusty but I seem to recall that in common law, silence is not consent. You also may have the unfair contract terms act that comes into play. They have extended your insurance without payment, therefore on credit, Consumer credit acts??

If I'm allowed to suggest this, nip over to www.traffic-answers.co.uk and post on there. A guy called FNG (among others) may have some advice to put your mind at rest.

But, I would agree with others....Tell them to Foxtrot Oscar.

The thing that springs to mind is whether it is the insurance company that is demanding payment, or whether it is a finance company that has paid the insurance premium that is demanding payment. one has to be careful what one signs. doesn't one.
