Via e-mail a correspondent's view of this judgement, in relation to the taxi/PH trade is;

Principle or Agent?
Who ever controls the telephone number controls the business.
"point of sale means gross turnover", therefore drivers are being exploited by their operators, and are bogus self employed.
However if they claim to be truly self employed and agree to have the same fares set by their operator, then this is clearly price fixing.

I think it would be helpful if contracts actually had to be agreed and signed between the operators and drivers. Usually it's just the 'you give me £Xs and I'll let you work our system', but, be assured that I will make you no promises as to any real remuneration
