The strict definition of ‘street’ as in the Town Police Clauses 1847 must go in any new legislation and be buried or even cremated, just to be sure it’s dead!! If there is anything that has caused confusion in prosecutions and ploughed £millions into the coffers of solicitors’ and barristers’ bank accounts over the last [154 years] sorry 164 years [nearly did a Mr T then], it is this one definition. The idea of ‘street’ within the ‘prescribed distance’ as per the TPC 1847 should IMO be replaced by ‘wheresoever a hiring is effected within a licensed area’. That would stop all the b*llsh*t about illegal ranking on private land, private property, the back garden, etc., etc., And before anyone points it out, I DO KNOW the consequences for me personally. |

Have to bump up this post! Anyone know if there is anything in the proposals that is relevant to the “Private Land” issue? |
