14.30 Non-business hire

On the other hand, services may be provided for profit without necessarily being in the course of business. It may not be easy to decide what frequency of activity is enough to cross such a threshold. Although a business does not have to be full time it should be more than a hobby. The issue has arisen in the consumer sales context in respect of eBay sellers passing themselves off as consumers when in fact they are businesses.

In the context of taxi and private hire licensing this might be relevant to the owners of classic taxis who might occasionally hire them to the public; if done at an amateur level and only in order to maintain the vehicle, it may not amount to business use. Generally, such activities would not be caught by licensing requirements.


The bit on Bold.....has anyone any idea why the LC dont see it fit to add an example of this or a citation?

Are some of you polishing taxis on a night to hire them out during the day at cost price?

Hobby or not if they are being hired to the public they should be licensed, how else do you make sure they are safe and the driver is safe :?

Sometimes it seems the LC think that everyone out here is an honest Joe, and no-one would even consider a touch of naughtiness.

But in the real world we all know that their are 1000s of folks driving outside of the law now, bring the non-business scam rule in and there with be many 1000s more.

Doesn't make sense the LC coming down on licensing Wedding cars, but allowing some doddery old mush to charge for running his old vintage motor.

Can of worms LC, don't do it. [-X
