Letter sent to Minister by Stakeholders opposed to Clause 12

Amendments proposed by the Local Government Association

Is there anyone who thinks the LGA proposals will happen this late in the day? :-k

As for the letter to the Minister, methinks scaremongering can only go so far. [-X

I'm still waiting for the campaign to begin where all those signed up to the clause 12 letter start lobbying to get rid of those rules in London.

Quite how the GMB London rep can sign that document, when the cars on his circuit are doing each and every day what he is scaremongering about, beggars belief. [-(

I can understand what your saying, but the wider picture means clause 12 will unleash anarchy - the government need to address cross border HC's IMO - local authorities cannot be undermined by national government surely?

Why do I get this vision of enforcement officers behaving like starsky and hutch..and then public safety will be a issue. #-o #-o #-o

aint sure, why do I get a feeling of LO's sitting on their backsides and not using the powers they would have?

I am extremely uncomfortable with the political undertone of the letter - but appreciate, getting all the groups to agree in a short period of time would have ben difficult.

Following on from what the Captain said, why do enforcement officers need extra powers when most of them don't use they ones they already have?

Some chap wanted this inserted instead;

Hirings accepted on behalf of another operator.

    1. A PHV operator (“the first operator”) who has in a controlled district accepted a private hire booking may not arrange for another operator to provide a vehicle to carry out that booking as sub-contractor unless—

    a) the other operator is a London PHV operator and the sub-contracted booking is accepted at an operating centre in London;

    b) the other operator is licensed under section 55 of the Local Government (Miscellaneous Provisions) Act 1976 (in this Act referred to as “the 1976 Act”) by the council of a district and the sub-contracted booking is accepted in that district; or

    c) the other operator accepts the sub-contracted booking in Scotland.


    2. A PHV operator who contravenes subsection (1) is guilty of an offence and liable on summary conviction to a fine not exceeding level 3 on the standard scale.

    3. It is a defence in proceedings for an offence under this section for an operator to show that he exercised all due diligence to avoid committing such an offence
.
    4. It is immaterial for the purposes of subsection (1) whether or not sub-contracting is permitted by the contract between the first operator and the person who made the booking.

    5. For the avoidance of doubt (and subject to any relevant contract terms), a contract of hire between a person who made a private hire booking with the PHV operator who accepted the booking remains in force despite the making of arrangements by that operator for another contractor to provide a vehicle to carry out that booking as sub-contractor.

    6. The first operator must advise the customer of the job being sub-contracted.

    7. The first operator must advise the passenger of the fare that will be charged.

it was the NTA who were responsible for organising a meeting in Bolton where MP's - crime commissioners and others were present - the meeting was hosted by NALEO :wink:
