I'm pretty certain both are currenty offences under the road traffic act.

No.

You are allowed to not ensure (not good English I know) the 14 year old puts his seat belt on.

But the law will not allow WAV drivers the option of not ensuring wheelchairs are safety secured.

Now what definition we will get, if any, of safely secured, we will have to wait and see.

As for the scenario Mr T sets out about the lady who wants to go sideways, well maybe the vehicles that take her will have to find a way to secure her sideways in a safe manner.

Else the problem will be the ladies not ours, as we will have the get out of not being happy to take the job after having a risk assessment.

That problem could become the Drivers very quickly if he Stops suddenly and 3 Cwt of Metal and disabled Passenger Comes crashing towards them...Messy!!!

Interesting discussion but as an experienced operator of wav's there are a s many unanswered questions

Firstly what do they define as secured my first wav used to have 2 clamps my current one has four straps but if one wheelchair is strapped in then a second wheelchair can only be got in facing backwards and there is insufficient room to place straps around it and with another chair in cannot topple over or anything because space is severely restricted so if it becomes compulsory then vehicles will become limited to one wheelchair only which might not go down well with local nursing homes

Pushchairs now as much as i would like to strap chairs in try telling that to the mums many insist that their little ones face forwards with them holding the chair ! and often have large amounts of shopping attached to the handles making it impossible to use the seatbelts on the rear facing seats to secure the chairs which is the best way as the wheelchair straps would almost certainly damage pushchairs when tensioned ! Then there are the DOUBLE BUGGIES the ones which have the 2 children sat side by side will fit up against the seats but the ones which have the children one behing the other certainly don't and generally will only fit into the vehicle sideways.

And if there are two mums 2 or 3 young children and 2 pushchairs its almost impossible to arrange the passengers in any way which would let you strap in the pushchairs

These laws are all well and good but they are written by people who are unfamiliar with the practical aspects of what they are legislating and will make it harder not easier to carry out such work which will in turn discourage drivers from doing that kind of work
