Taxi driver loses appeal against suspension after complaints against him and brushes with police

A Scunthorpe taxi driver has lost his appeal against a three-month suspension of his licence after complaints against him and brushes with the police.

Mohammed Khan, owner of E J Cars, was upset at a decision by North Lincolnshire Council's licensing sub-committee.

He appealed to Grimsby Crown Court and claimed that the decision in November last year that he was "not a fit and proper person" to hold a licence was wrong.

The suspension had not been activated pending the appeal.

Mr Khan told the court that he had been a taxi driver for about nine years and employed seven other drivers.

The court heard that he was given a six-month conditional discharge by magistrates in September last year for failing to stop for police in September 2016.

There were also letters of complaint from other taxi drivers from 2015 and 2016 with claims about jumping traffic lights, speeding and insulting a driver.

There was also a claim about a "hit and run" incident but he denied the allegations.

Mr Khan still faces a prosecution over a claim that he drove at 73mph in a 40mph limit in April.

He claimed that it was "shocking" that he was given a three-month licence suspension for a "first mistake".

But Ben Williams, representing the council, said the suspension was "legitimate and right" and was "arguably lenient".

Defence barrister Ashleigh Metcalfe said that there was "no pattern of offending" and Mr Khan was nothing other than safe and responsible when carrying paying passengers in his taxi.

Judge Roger Thomas QC, sitting with two magistrates, rejected Mr Khan's appeal.

"He has failed by some distance to establish that this decision by the committee was wrong," said Judge Thomas.

"Without any real hesitation, this is an appeal that fails."

Mr Khan had "belittled" the claims against him by saying they resulted from "misidentification and misunderstanding" as well as people who were "badly motivated towards him".

He was ordered to pay £1,690 costs. He will also have to pay an outstanding £1,000 costs from a hearing before magistrates.

The suspension starts immediately.

Sounds like the kind of driver that believes rules are for others.

Maybe the council should insist he has CCTV installed in his car once his suspension is over.

I somehow doubt that will be neccessary

more than 30mph above limit that's usually an automatic ban unless your David Beckham

I would say most doing more than 30mph above get more points than a ban.
