A DRINK driving pensioner who was employed as a taxi driver in Barrow was found behind the wheel wearing only his boxer shorts, a court heard.

Geoffrey Thomas Albery, of Highlands Avenue, Barrow, had no trousers on when a woman and her children entered his vehicle for a taxi fare, prosecutor Lee Dacre said.

South Cumbria Magistrates’ Court heard a member of the public saw that a Volkswagen Passat was ‘parked funny’ in Aldi Car Park on Risedale Road on the evening of August 23.

They noticed the vehicle had a flat tyre and told a woman she should not get in the vehicle with her children, Mr Dacre said.

The court heard she ignored the advice and instead got into the 69-year-old’s taxi.

When she saw he was sat behind the driver’s seat wearing only his boxer shorts, she quickly got out and ran away from the scene with her children, the prosecution said.

Mr Dacre said the defendant denied he was drunk when the witness questioned Albery.

They felt the need to remove the car keys from the defendant so he couldn’t drive off, the court was told.

Albery was arrested after providing a positive breathalyser test at the roadside of 94 micrograms in 100 millilitres of breath.

The court heard this level had dropped to 86 micrograms in police custody. The legal limit is 35.

In mitigation, duty solicitor Karem Templeton said: “He would like to apologise to the court. This was out of character for him.

“It was Saturday evening. He had been watching the football and was wearing a T-Shirt and shorts. He had been having a drink at home when he fell asleep.

“When he woke up, he was disorientated. He thought it was the following morning when it was 7:20pm that evening. He was compliant with police and admitted the offence in police interview.

“He was working as a taxi driver. He has since lost his job and given up his licence as a taxi driver to the council. It is going to be difficult at his age to get anymore work. There are a lot of consequences for him."

Magistrates fined Albery £211 and disqualified him from driving for a period of 22 months.

However, he was offered the opportunity to complete a drink driving rehabilitation course, which if completed successfully, would reduce the length of ban by 22 weeks.

In addition, he was ordered to pay an £84 victim surcharge and £85 in court costs.

"Given up" his badge to the council? That's one way of putting it, but I don't think that's how it works

And if you've just got a basic state pension, or whatever, then that might not pay the bills. But he's 69, and it's made to sound here like he's still considering career options. Or whatever

But the great unknown is obviously how he came to be picking up a run - I'd guess he was working for an office on some kind of 'open shift' thing, and just logged on on the Saturday night and no one in the office would be any the wiser that he was in his boxers and blootered?

2 very expensive hobbies so maybe that's why he needed to work to supplement his pension

So the car was parked iffy, and the lady was advised that the car had a flat tyre, yet this woman still got into it with her kids.
