and the Judge believed him, but he didn't understand the case properly. Is there anything I can do? Is it worth fighting?

Do you think my insurance company would pay for that? If not how much could it cost me?

The chances are your insurance company won't pay, though no harm in asking.

In my experience, insurance companies have such a thing called, 'the memorandum of understanding'. This means they won't go into litigation against each other because of legal costs. This means it's up to you to fight it yourself or hire legal counsel.

I had a similar problem a number of years ago, but fortunately for me, they backed-down rather than go into court.

What court was it? Small claims or higher?

I would ask your insurers to appeal, but it's odds on they will not.

Can't believe you didn't get one or two independant witnesses. :roll: :roll:

was 3 weeks later when he pulled me up in the street, said he knew it was me cos he had the first 4 digits of my reg. Got a letter from M&O saying there's hundreds of cabs starting with that prefix so he pulled up a new witness who had only taken note of 3 digits, the 3 that he needed to put it on me. She was an independent witness who turned up with him to Court and hung around for an hour after giving her evidence to go home with him.
