Thanks for your email. The Council has been aware of the Brentwood v Gladen case since 2004 and has relied upon it in our response to the judicial review case.

I think it should be pointed out that these vehicles although licensed as hackney carriages are being used for private hire work.

The legality is there to be tested in the courts, should any licensing authority feel that way inclined. It doesn't really matter what you, I or anyone else thinks, the law is the only arbiter and as long as the law allows, people will choose where they want to license.

There was a post last year from Darlington, with the same dilemma does anyone know the outcome?????

I understand the license holder made a court administration error in her appeal and the case never went to court. In short I believe she failed to pay the correct court fees.

I suspect she isn't too concerned as she will no doubt have most of her vehicles licensed with Berwick.
