I wonder if the general public in Lincoln are aware that their council has an effective 2 tier form of vetting applicants for taxi and ph licenses?

You see if you were born in the UK you must produce DBS

If you are born abroad you must produce a certificate of good conduct - but don't worry - if you cant produce one, you'll get a license anyway;

The Sub-Committee interviewed an applicant for a Private Hire Vehicle Driver’s Licence who could not supply a certificate of good conduct from his previous country of residence. [21/2014]


The decision was made as follows

That the licence be granted.

Reasons for decision

1. The Sub-Committee were satisfied with the explanation given by the applicant and were sympathetic to the difficulties in obtaining documentation from his native Afghanistan.2. The Sub-Committee felt the applicant presented himself well and was open and honest.

3. The Sub-Committee had no reason to doubt that the applicant was anything other than fit and proper person to hold a licence.

The Sub-Committee interviewed an applicant for a Private Hire Vehicle Driver’s Licence who could not supply a certificate of good conduct from his previous country of residence and had a conviction for a major traffic offence. [22/2014]

Its the same Nationwide and defo in London ..............the normal question wot yer gonna do about it...............normal answer ZICH :badgrin: :badgrin:

Similarly present a UK driving licence with 6 points for 2 lots of speeding and you won't get a taxi licence; present an EU licence where they can't check what you've done before and you'll get a taxi licence.

The EU licence doesn't hold points does it? The reason I've come to this conclusion is, a foreign driver who works in our town was caught doing 65MPH in a 30 zone, he was fined £1,000, no points and no ban because he was driving on a EU licence.

You have to have held a UK license for 12 months to apply for a badge here.

EC Licence
If you are resident in Britain and have an EC licence, your licence can be endorsed by the courts and a counterpart will be issued. This means that you can take advantage of the fixed penalty system. If you have an EC licence but are not resident then see below.

Foreign Licence (non EC and EC non resident)
You cannot pay the fine and substantiate the ticket. You must go to court to be dealt with. You must still produce your documents (if requested) within 7 days but cannot surrender your licence to the police. You will receive a summons in the post in due course with a court date. Your licence will not be endorsed but you may get a higher fine.

When i had cars in Lincoln City district i had a 55 year old driver who had lived in uk all his life and never been in trouble but had moved house. His CRB took 6 weeks to come back as they had to check 2 diff police areas.
At the same time an Iranian guy applied. His CRB was done on the 3 weeks he had been in UK. The Iranian embassy at the time did not give out details of peoples past so his badge was done and dusted in 2 weeks.
I questioned Lincoln City council about it as to me it seemed a bit daft but was told thats all they could do.

Five foreign Lincoln taxi drivers get licences 'without proper checks'


At least five foreign taxi drivers have been given licences in Lincoln in recent months without proper background checks.

Since November, the City of Lincoln Council has issued licences to five drivers from Iraq, Iran and Afghanistan.

The decisions were made without any official paperwork from their countries, but there is no suggestion these drivers have criminal records.

It is unclear how many others have also been issued licences and the city council did not respond to a request for figures.

But Jim Hart, 63, a Lincoln taxi driver for more than 30 years, said: "I wouldn't get a licence without a disclosure and barring service check but criminal record checks on people from outside the EU only cover for as long as they've been in the country.

"But it seems strange to me. If they're unable to get a letter of good conduct, there's nothing to say what a driver may have or may not have done before coming to the UK, and that's worrying.

"The council has been unable to check the backgrounds of these foreign applicants but issued licences in good faith.

"I think that's wrong."

Officials must be satisfied people are 'fit and proper' to hold taxi licences, based on the UK-wide Disclosure and Barring Service, formerly CRB, checks.

In addition, foreign nationals and UK nationals who have lived abroad must supply a good conduct certificate via their embassies.

But the recent Lincoln licences were decided without good conduct documentation.

The decisions on the foreign drivers have been made at three secret meetings held at City Hall in the last three months.

According to minutes of those meetings, members of the Hackney Carriage and Private Hire Licensing Sub-Committee said that they understood people's difficulties in obtaining such documents from overseas.

And after hearing from applicants, they concluded there was no reason to doubt their good character.

A review into the council's taxi policy will take place later this year.

Kevin Barron, the council's licensing manager, said:

"The fit and proper test means the council has to ensure so far as possible that those licensed to drive private hire vehicles and hackney carriages are safe drivers with good driving records and adequate experience, sober, mentally and physically fit, honest, and capable of conducting their business in an appropriate manner."
