I agree.....The Scottish executive have no real power so they get their rocks off by making life as difficult as possible for all of us scots by way of causing as much low key mischief as they can legally do...after all they have to account for their salary and perks somehow.

Id be quite happy to see this needless tier of government shut down forever and save us billions of pounds in duplicated non jobs and duplicate jobsworths..

I tend to agree but nevertheless, it is they who have this power now.
The 1982 act gave the power to the Secretary of State for Scotland and it passed to Holyrood on devolution.

The Sneddon case is going ahead because his council (according to the sheriff) acted beyond their powers in requiring all taxis to be WAVs.
The power to decide which types of vehicles can be used as taxis was bestowed upon the SoS by the 1982 act.
That power was subsequently inherited by the Scottish Exec in 1999 as a devolved power.

To date this power has not been used in this manner

Yes, for the moment, but that may not be the final word on it.
WAVs can be imposed if the Scottish Exec actually use their powers.

That could also be open to a legal challenge.

This was a letter in todays press from the Dundee Wheelchair Taxi Association Chairman.



I RESPOND to the taxi drivers speaking out about disabilities.
What we are saying is that no person should be driving any vehicle, especially a taxi in Dundee, if they have disabilities.

In the interest of public safety, there should be no drivers with severe disabilities that impair their judgment while doing their job of work.

Taxi drivers do not have regular medicals — basically taxi drivers are allowed to work for 40 years or more and are only required to have an initial medical when they originally apply for a licence.

Nobody should be driving a public vehicle if not fit to do so, especially taxi drivers.

Members of the public should have skilled and fit people driving taxis.

It’s obvious that certain people have certain disabilities and they should not really be driving the public about. — Dundee Wheelchair Taxi Association Chairman.
